CELLULAR ANTENNA TOWER REGULATIONS
On November 19, 2002, the Owensboro
City Commission adopted Article 20.
On November 21, 2002, the Daviess County Fiscal Court adopted Article 20.
As of January 10, 2002, the Whitesville City Commission had not taken action.

Background
In the spring of 2002, the Kentucky General Assembly delegated the authority for approving the locations of cell towers to local planning units. The Owensboro Metropolitan Planning Commission will be the entity to review and take final action on proposed cell tower locations within the City of Owensboro, the City of Whitesville, and the remainder of Daviess County.
On May 9, 2002, the OMPC appointed
an 8-member committee to review and recommend procedures for the OMPC to process,
review, and finalize applications for new cell towers. The adopted Comprehensive
Plan currently contains a telecommunications
element

kb that outlines requirements for new cell tower applications. However,
the Comprehensive Plan serves only as a guide and currently there are no adopted
zoning regulations applicable to cell towers.
On July 8, 2002, at Owensboro City Hall, the Cell Tower Review Committee held this forum to provide an introduction to this issue and an opportunity for questions, answers, and comments. Review the minutes and the slide presentation from the public forum.
On August 8, 2002, the OMPC agreed with a recommendation by the Cell Tower Review Committee to hold a public hearing at the OMPC's monthly meeting on September 12, 2002, to consider adoption of Cellular Antenna Tower Regulations as a new Article 20 of the Owensboro Metropolitan Zoning Ordinance.
On September 12, 2002, after a public hearing, the OMPC approved the proposed regulations and subsequently forwarded its recommendation for adoption to the legislative bodies.
